ASSOSEMENTI ed i diritti dei contadini
E’ stato recentemente pubblicata la notizia di un accordo tra Assosementi e l’Ispettorato centrale della tutela della qualità e della repressione frodi dei prodotti agroalimentari (ICQRF).
In questo accordo si legge: “ … Sul versante delle specie agrarie, ad esempio, la vendita o lo scambio di granella non certificata uso seme, oltre a costituire violazione della normativa sementiera, …” e, ancora, “…Nel settore sementiero orticolo, invece, è crescente il diffondersi di pratiche illegali quali la riproduzione vegetativa a mezzo talea o stubs …”.
Noi contadini, consapevoli dell’enorme ricchezza di biodiversità che ci è stata trasmessa dalle generazioni di contadini che ci hanno preceduto nei passati millenni, con sapiente opera di selezione, scelta di sementi adatte ad ogni particolare ambiente e scambio di sementi fra coltivatori, affermiamo la nostra ferma volontà di continuare con coscienza, senso di responsabilità, impegno questa opera di creazione di diversità biologica adatta ai vari ambienti e fondamentale nel mantenere in vita le nostre aziende.
Riguardo la notizia sopra riportata, osserviamo che:
1 – ASSOSEMENTI ha proposto un accordo ad una istituzione pubblica sulla base di un presupposto giuridicamente inesistente: nessuna legge italiana vieta la risemina di varietà certificate, quindi non esiste il presupposto della falsificazione per la granella scambiata tra contadini.
2 – la legislazione sementiera italiana protegge le industrie sementiere nella commercializzazione di sementi certificate e cartellinate con una serie di disposizioni che le industrie sementiere debbono rispettare, molte di queste disposizioni però per volere delle industrie stesse sono sottoposte solo all’autocertificazione, quindi le imprese sementiere, ad esempio, guardino in casa loro chi, acquistando sementi non imballate sul mercato mondiale, cartellina in Italia in modo forse fraudolento e mette in commercio sementi certificate di dubbia origine. E’ un loro problema.
3. L’Italia, come la UE, ha ratificato e poi legiferato per l’applicazione del Trattato internazionale delle risorse genetiche per l’agricoltura e l’alimentazione dove gli articoli 6 e 9 riconoscono il diritto degli agricoltori di scambiare e vendere, oltre che seminare e riseminare, le proprie sementi “…e altro materiale di moltiplicazione”.
In conclusione, NON siamo NOI contadini ad avere pratiche illegali. Chiediamo che il Ministro Martina chiarisca la fonte giuridica, il senso e la portata di tale accordo oltre ad imporre anche ad ASSOSEMENTI il rispetto della legislazione nazionale e dei trattati internazionali che proteggono il diritto degli agricoltori. Ricordiamo che nessuno può entrare nei nostri campi senza un mandato – tantomeno un’impresa sementiera – ne indagare sulla natura della granella che vendiamo ad altri contadini.
Ci sentiamo liberi di utilizzare – e continuare ad utilizzare – le sementi che produciamo per la semina e ri-semina nei campi che lavoriamo e di scambiare queste sementi da noi prodotte con altri contadini.

ASSOSEMENTI and farmers’ rights
In this agreement is said: “… In terms of agricultural species, for example, the sale or exchange of non-certified grain used as seed, in addition of constituting violations of the seed legislation, …” and, again, “… In the horticultural seed sector, instead, the spread of illegal practices such as vegetative reproduction by cuttings or stubs is increasing… “.
We, peasants, aware of the enormous wealth of biodiversity that has been passed from generations of farmers who have preceded us in past millennia, with meticulous selection, choice of seeds suitable to each particular environment and seed exchange among farmers, we affirm our determination to continue with awareness, sense of responsibility and commitment this work of biological diversity of creation adapted to various
environments and critical in keeping alive our companies.
Regarding the news reported above, we observe that:
1 – Assosementi has proposed a deal to a public institution on the basis of a legally non-existent premise: no Italian law prohibits the re-seeding of certified varieties, so there is no assumption of forgery for grains exchanged between farmers.
2 – The Italian seed law protects seed industries in the trading of certified and labeled seeds with a series of provisions that the seed industry must respect, many of these provisions, however, at the behest of the same industries, are subject only to self-certification, so the seed companies, for example, should look singularly those who, buying unpackaged seeds on the world market, label them in Italy in a potential fraudulent way and trade certified seeds of dubious origin. It is a problem of theirs.
3. Italy, as the EU, has ratified and then legislated in order to the implementation of the International Treaty on Genetic Resources for Food and Agriculture, where the articles 6 and 9 recognize the farmers’ right to exchange and sell, as well as sow and sow again their seeds “… and other planting material.”
In conclusion, it is NOT US, the farmers, to have illegal practices. We ask the Minister Martina to establish the
legal source, the meaning and the scope of this agreement and, at the same time, to impose to Assosementi
the compliance with the national legislation and international treaties that protect the right of farmers.
We remember that no one can enter our fields without a warrant – least of all a seed company – neither
investigate the nature of the grain that we sell to other farmers.
We feel free to use – and to continue to use – the seeds we produce for the sow and re-sow in the fields we work, as well as to exchange these seeds produced by us with other farmers.
